Emissions Compliance in Simple Terms
Rules for emissions systems, inspections, readiness monitors, registration, and road use vary by country, state, province, and local jurisdiction.
The customer is responsible for checking local laws before purchasing or using any OBDTune product or service.
OBDTune does not guarantee that any vehicle will pass emissions testing, readiness monitor inspection, registration inspection, safety inspection, or any other government, state, provincial, or local inspection.
Customer Responsibility
The customer is solely responsible for ensuring that any product or service purchased from OBDTune complies with all applicable laws, regulations, inspection rules, registration requirements, emissions rules, road-use rules, and local requirements.
This includes laws and rules related to emissions, vehicle inspection, registration, road use, commercial vehicle use, import, export, and any other local requirements that may apply to the vehicle or product.
OBDTune does not provide legal advice. If the customer is unsure whether a product or service is legal for a specific vehicle, location, or intended use, the customer should consult a qualified legal, regulatory, emissions, inspection, or compliance professional before purchase or use.
Local Laws May Vary
Emissions, inspection, registration, and road-use rules vary by jurisdiction.
A product or service that may be permitted, tolerated, or not inspected in one location may be restricted, prohibited, or fail inspection in another location.
The customer is responsible for checking the rules that apply to:
- the country where the vehicle is used;
- the state, province, or region where the vehicle is registered;
- the location where the vehicle is inspected;
- the intended use of the vehicle;
- whether the vehicle is used on public roads, private property, off-road, for export, competition, testing, or other purposes.
Public Road Use
Some OBDTune products or services may affect emissions-related systems, diagnostic readiness monitors, inspection results, registration eligibility, road-use legality, warranty coverage, or compliance status.
Some products or services may not be legal for use on public roads in certain jurisdictions.
The customer is responsible for determining whether the purchased product or service is legal for the intended vehicle and intended use.
OBDTune is not responsible for any consequences resulting from the customer’s use of a product or service in a way that violates applicable laws or regulations.
Emissions Systems and Vehicle Functions
OBDTune products and services may relate to or affect systems such as:
- SCR / DEF / AdBlue systems;
- DPF systems;
- EGR systems;
- EKAS or intake-related systems;
- NOx sensors;
- emissions-related control units;
- diagnostic readiness monitors;
- ECU or control unit software;
- warning messages, countdown messages, or related diagnostic functions.
The effect of a product or service may vary depending on vehicle model, year, engine, market version, software version, hardware version, condition, prior repairs, modifications, and local inspection rules.
No Inspection or Registration Guarantee
OBDTune does not guarantee that any vehicle will pass emissions testing, readiness monitor inspection, registration inspection, safety inspection, or any other government, state, provincial, or local inspection.
Readiness monitor results, inspection procedures, emissions standards, and pass/fail rules vary by jurisdiction and may change over time.
Inspection methods may also vary by jurisdiction. Some inspections may rely primarily on OBD readiness monitor status, while others may include visual inspection, tailpipe emissions measurement, opacity testing, smoke testing, or other procedures.
OBDTune does not guarantee that any vehicle will pass any specific inspection method.
The customer is responsible for confirming inspection and registration requirements before purchase, installation, or use.
Readiness Monitors
Some OBDTune products or services may affect OBD readiness monitor status.
Readiness monitor requirements vary by jurisdiction. Some jurisdictions may allow one or more monitors to be not ready, while others may require all applicable monitors to be ready.
OBDTune does not guarantee any specific readiness monitor result or inspection outcome.
The customer is responsible for checking whether the vehicle’s readiness monitor status is acceptable in the location where the vehicle will be inspected or registered.
No Legal Compliance Warranty
OBDTune does not warrant or guarantee that any product or service is legal for public road use, registered vehicles, commercial vehicles, emissions-controlled vehicles, or any specific country, state, province, or local jurisdiction.
The customer assumes responsibility for legal compliance, inspection compliance, registration compliance, and permitted use.
Customer Assumption of Risk
By purchasing, installing, or using an OBDTune product or service, the customer acknowledges and accepts that use of the product or service may carry legal, inspection, registration, warranty, emissions, or road-use risks depending on the customer’s location and intended use.
The customer assumes all responsibility for checking and complying with applicable laws and regulations.
No Responsibility for Penalties or Consequences
To the maximum extent permitted by law, OBDTune is not responsible for consequences resulting from the customer’s use of a product or service in violation of applicable laws, inspection rules, registration requirements, or road-use restrictions.
This includes, but is not limited to:
- failed inspections, registration problems, fines, penalties, or enforcement actions;
- warranty denial, vehicle downtime, repair costs, diagnostic costs, or towing costs;
- legal claims, third-party claims, or other related losses.
Off-Road, Export, Testing, Competition, or Non-Public-Road Use
If a product or service is purchased for off-road, export, testing, competition, private property, or other non-public-road use, the customer remains responsible for ensuring that such use is permitted by applicable law.
Labels such as “off-road,” “competition,” “testing,” “export,” or “private use” do not automatically make a product or service legal in every jurisdiction.
The customer is responsible for verifying the permitted use before purchase, installation, or operation.
Changes in Laws and Inspection Rules
Emissions laws, readiness monitor rules, inspection procedures, enforcement priorities, and registration requirements may change over time.
OBDTune is not responsible for changes in law, inspection procedure, enforcement policy, or registration requirements that occur after purchase, installation, or use.
The customer is responsible for checking current rules before purchase and before inspection or registration.
